This agreement is between you and vamAI ("we") and covers the vamAI desktop app ("the app"). By installing or using the app you accept it. If you do not, do not use the app.
1. You must be an adult
The app is for adults only. You must be at least 18 years old, and old enough to view sexually explicit material where you live. Do not use the app if this material is illegal where you are.
2. What the app is
The app connects Virt-A-Mate (a separate product by MeshedVR, which you must obtain yourself; we are not affiliated with MeshedVR) to artificial intelligence services that you choose and pay for: language models, voice synthesis and speech recognition. The app sends your conversation, and information about your Virt-A-Mate scene, to the services you configure, and plays back what they return.
3. AI disclosure
The characters you talk to are fiction generated by AI. They are not real people, they have no feelings, and what they say can be wrong, inconsistent or inappropriate. Nothing a character says is advice of any kind. The app is not a substitute for human relationships, therapy or medical care. If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line now.
4. Your AI provider accounts and keys
You supply your own accounts and API keys for the AI services. You are responsible for:
- following each provider's terms of service and content policies;
- every charge your providers bill you, including charges caused by the app running as you configured it;
- keeping your keys secret. The app stores them only on your computer.
We do not operate these services and are not responsible for what they do with your data, for their availability, or for their output.
5. What you may not do
You may not use the app to create, request or depict:
- anyone under 18, or any character presented as under 18;
- a real, identifiable person — including celebrities, public figures and people you know — in sexual content, or in any content without their consent;
- non-consensual sexual content involving real people;
- anything illegal where you or the content's subject live.
You may not resell, rent or redistribute the app; remove its notices; circumvent its license checks or feature limits; or reverse engineer it except where the law allows you to.
6. License and membership
We grant you a personal, non-exclusive, non-transferable license to use the app on your own computers. Some features require an active membership; which features, and on how many devices, is described where you sign up. A membership can lapse or be cancelled, and those features stop working when it does. The free features stay available.
7. Your data
The app keeps your settings, characters, conversations and memories in its own folder on your computer. It sends data only to:
- the AI services you configure (see section 2);
- our license server, when you sign in or the app checks your membership: your account identifier, an anonymised identifier for the device, and the app's version. Never your conversations or keys.
Logs and diagnostics stay on your computer unless you choose to send them to us.
8. Third-party software
The app includes open-source software under its own licenses, listed in
THIRD_PARTY_NOTICES.txt. Nothing in this agreement limits your rights under
those licenses.
9. No warranty
The app is provided "as is", without warranty of any kind. To the maximum extent the law allows, we are not liable for any indirect, incidental or consequential damages, or for any provider charges, arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
10. Ending this agreement
You may stop using the app at any time. We may end your license if you break this agreement. Sections 4, 5, 9 and 11 survive.
11. General
We may update this agreement; the app will ask you to accept a changed version before you continue. This agreement is governed by the laws of [jurisdiction — to be decided].
