1. Acceptance of Terms
By accessing or using vamAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
vamAI provides AI-powered interactive companion software that integrates with Virt-a-Mate (VaM). The Service includes the vamAI desktop app, the vamAI plugin for VaM, this website, and the services behind them that handle sign-in, memberships, licences and downloads.
The app works with AI services that you choose and use under your own accounts. vamAI does not provide or resell AI processing.
The desktop app is also covered by its License Agreement, which you accept when you first run it.
3. Subscription and Payment
- Some features of vamAI may require an active membership of vamAI's Patreon page.
- Subscription fees are billed monthly through Patreon's payment system.
- You may cancel your subscription at any time through Patreon.
- Upon cancellation, you will retain access until the end of your current billing period.
- Refunds are handled according to Patreon's refund policy. A refunded or charged-back payment ends the access it paid for.
4. Sign-In and Devices
- You sign the app in with your vamAI account, which you create by signing in with Patreon on our website.
- A membership can be used on a limited number of your own computers, which you can see and manage on your dashboard.
- A free trial, where offered, can be started once per computer.
- Your account and the app's sign-in are for your personal use, are non-transferable, and may not be shared, sold, or distributed.
- We reserve the right to end app sign-ins, or remove computers, that violate these terms.
- If a computer is lost or you stop using it, remove it on your dashboard; this signs the app out on that computer.
5. Acceptable Use
You agree not to:
- Share, resell, or redistribute the software, your account, or the app's sign-in.
- Reverse engineer, decompile, or attempt to extract the source code.
- Use the Service for any illegal or unauthorized purpose.
- Attempt to bypass or circumvent any security measures.
- Interfere with or disrupt the Service or servers.
- Use automated systems to access the Service beyond normal usage.
6. Intellectual Property
The Service, including all software, content, and materials, is owned by vamAI and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes only.
7. Third-Party Services
The Service integrates with third-party services including Virt-a-Mate, Patreon, and the AI services you choose. Your use of these services is subject to their respective terms and conditions, and any charges for AI services are between you and their providers. We are not responsible for the availability or functionality of third-party services.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE SERVICE IS AT YOUR OWN RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAMAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.
10. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes when possible. Continued use of the Service after changes constitutes acceptance of the modified terms.
11. Termination
We may terminate or suspend your access to the Service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your license to use the Service will immediately cease.
